Terms of Service

The legal agreement, service level expectations, and acceptable use policies for agencies using the platform.

1. Agreement to Terms

These Terms of Service ("Terms") form a legally binding agreement between The Waiver Academy ("we," "us," or "our") and the agency or individual ("you") accessing our workforce training and compliance platform. By creating an account, starting a trial, or using any part of the platform, you agree to these Terms.

If you are accepting these Terms on behalf of an agency or organization, you represent that you have authority to bind that organization.

2. The Services

The Waiver Academy provides online compliance training, staff management, competency tracking, reporting, and related consulting services for home and community-based service (HCBS) providers and healthcare organizations. Features available to you depend on your subscription plan.

3. Accounts & Responsibilities

  • You must provide accurate agency and contact information and keep it current.
  • You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.
  • Agency administrators are responsible for managing staff access and ensuring staff accounts are deactivated when employment ends.
  • Each staff seat is for one named individual — credentials may not be shared between staff members, as this compromises the integrity of training records.

4. Subscriptions, Trials & Billing

  • Free trials last 30 days unless otherwise stated. No credit card is required to start a trial.
  • Paid subscriptions renew automatically on a monthly or annual basis until cancelled.
  • Fees are based on your selected plan and seat count. Upgrades take effect immediately; downgrades take effect at the next billing cycle.
  • You may cancel at any time from your account settings. Cancellation stops future billing; fees already paid are non-refundable except where required by law.
  • We may adjust pricing with at least 30 days' notice before your next renewal.

5. Service Level Expectations

  • We target 99.9% platform availability, excluding scheduled maintenance windows announced in advance.
  • Support requests are answered in the order received; priority support response targets apply to Professional plans and above.
  • Training records, certificates, and compliance reports are backed up regularly.
  • While we work to keep course content aligned with state regulations, your agency remains responsible for verifying that its training program satisfies the specific requirements of its licenses, waivers, and contracts.

6. Acceptable Use

You agree not to:

  • Complete training or assessments on behalf of another person, or permit anyone to do so.
  • Enter client or patient Protected Health Information (PHI) into training records, notes, or support requests.
  • Copy, resell, scrape, or redistribute course content, assessments, or platform materials outside your agency.
  • Attempt to probe, disrupt, or gain unauthorized access to the platform or other agencies' data.
  • Use the platform for any unlawful purpose or in violation of applicable healthcare regulations.
  • Falsify training records, certificates, or compliance documentation.

7. Intellectual Property

All course content, assessments, software, branding, and materials on the platform are owned by The Waiver Academy or its licensors and are protected by copyright and other intellectual property laws. Your subscription grants you a limited, non-exclusive, non-transferable license to use the platform for your agency's internal training purposes. Certificates earned by your staff belong to those individuals and may be shared for verification.

8. Your Data

You retain ownership of the agency and staff data you submit to the platform. You grant us a limited license to process that data solely to provide the services. Our handling of personal information is described in our Privacy Policy, which is incorporated into these Terms.

9. Disclaimers

The platform is provided "as is" and "as available." While our content is developed by compliance professionals, The Waiver Academy does not provide legal advice, and completion of training on our platform does not guarantee regulatory compliance, survey outcomes, licensure, or certification by any state or accrediting body. You should consult your own legal and regulatory advisors regarding your specific obligations.

10. Limitation of Liability

To the maximum extent permitted by law, The Waiver Academy will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenues, or data. Our total liability for any claim arising out of these Terms or the services is limited to the amounts you paid to us in the twelve (12) months preceding the claim.

11. Termination

You may stop using the services and cancel at any time. We may suspend or terminate accounts that materially violate these Terms, fail to pay applicable fees, or pose a security risk. Upon termination, you may request an export of your training records within 60 days, after which data may be deleted in accordance with our retention policies.

12. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated through the platform or by email at least 30 days before they take effect. Continued use of the services after changes take effect constitutes acceptance of the updated Terms.

13. Governing Law & Contact

These Terms are governed by the laws of the United States and the state in which The Waiver Academy is organized, without regard to conflict of law principles. Questions about these Terms may be directed to our team through the Support page.
